Welcome to Magnolia Pine Studios. By accessing or using our website or booking our photography services, you agree to these Terms and Conditions (“Terms”). If you do not agree, please do not use our website or services.

1. Intellectual Property

All photographs, images, and content on this website are the property of Magnolia Pine Studios and are protected by United States copyright law. Unauthorized use, reproduction, distribution, or modification of any content is strictly prohibited. You may not use images for commercial purposes, AI training, or NFTs without our written permission.

You grant Magnolia Pine Studios the right to use images for marketing, portfolio, and educational purposes unless you request otherwise in writing within 14 days of receiving your images.

2. Liability and Indemnification

Magnolia Pine Studios carries liability insurance as required by Colorado law. However, you and your guests are responsible for your own safety during photography sessions.

You agree to indemnify and hold harmless Magnolia Pine Studios from any claims, damages, or losses resulting from unauthorized image use, failure to obtain required permits or releases, or injuries to third parties during sessions.

For weddings or large events, you may be required to provide proof of event insurance naming Magnolia Pine Studios as an additional insured.

3. Colorado Compliance

Privacy: We collect and use personal information as described in our Privacy Policy. This may include biometric data (such as facial recognition in editing software), which you can opt out of by contacting us. We retain data for up to 36 months.

Sales Tax: Colorado sales tax applies to physical prints and digital files sold separately. Digital files included with services are generally not taxable. Tax rates are based on your location in Colorado.

Late Payments: Late payments will incur a 1.5% monthly interest charge (18% annual rate).

4. Permits and Venues

You are responsible for obtaining any required permits for photography sessions at venues such as Red Rocks, Denver Botanic Gardens, or other locations that require permits. If you fail to provide a valid permit at least 72 hours before your session, your session will be canceled and your deposit forfeited.

5. Dispute Resolution

Any disputes will be resolved through binding arbitration in Denver County, Colorado, under the rules of the American Arbitration Association. Each party is responsible for their own legal fees unless a claim is found to be frivolous, in which case the claimant will pay our legal costs.

6. Session Cancellations and Force Majeure

Cancellation and rescheduling policies are outlined in your booking agreement. Deposits are non-refundable except as specified.

Magnolia Pine Studios is not liable for cancellations due to circumstances beyond our control, including poor air quality (AQI >150), park closures under Colorado law, or drone flight restrictions in the Front Range.

7. Appearance and Usage

By booking a session, you consent to the use of your likeness in our portfolio, marketing materials, and educational content, including online courses and YouTube tutorials.

8. Compliance and Audits

You must retain original digital files for seven years. We may conduct random audits to verify compliance with usage restrictions. Failure to provide files within 14 days of a request may result in a penalty of $250 per day.

9. Changes to Terms

We may update these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website or services means you accept the updated Terms.
